Terms of Service

Welcome to Agentix ("the Company", "we", "us"). These terms govern your use of the Agentix website and the Agentix web application ("the Platform"). By creating an account or using our services, you agree to these terms.
1. Services
Agentix provides a web-based platform for omnichannel conversation management, including WhatsApp and Instagram messaging automation, AI-powered automated responses, CRM integrations, and business workflow automation. The platform is designed for small and mid-size businesses to manage customer communications across multiple channels from a single interface.
2. Account Registration
To use the Platform, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old and authorized to act on behalf of the business you register. Each business should maintain one account. You must notify us immediately of any unauthorized access to your account.
3. Use of the Platform
You agree to use the Platform for lawful purposes only. You may not use the Platform to send spam, unsolicited messages, or abusive content through connected channels. You must comply with all applicable laws and the terms of service of connected platforms (including Meta's WhatsApp Business and Instagram policies). You may not reverse engineer, decompile, or attempt to extract the source code of the Platform.
4. Connected Platforms
When you connect your WhatsApp Business or Instagram accounts to Agentix, you are responsible for maintaining compliance with those platforms' terms and policies. Agentix is not liable for any actions taken by Meta or other platforms regarding your accounts, including suspension or policy changes that may affect your use of the Platform.
5. AI-Powered Features
The Platform offers AI-powered features that generate automated responses to customer conversations. These features are provided as-is. You are responsible for reviewing AI-generated content and ensuring it is accurate and appropriate for your business context. Agentix does not guarantee the accuracy, completeness, or suitability of AI-generated responses.
6. End-Customer Data
When you use the Platform to manage conversations with your customers, you act as the data controller for your end-customers' data. You are responsible for obtaining any required consent from your customers and for complying with all applicable privacy and data protection laws. Agentix processes your end-customers' data solely on your behalf to provide the service.
7. Intellectual Property
The Agentix platform, including its code, design, features, and documentation, is the property of Agentix and is protected by intellectual property laws. Your business data, conversation content, and any content you create using the Platform remain your property. You grant Agentix a limited license to process your content solely for the purpose of providing the service.
8. Payment and Billing
Access to the Platform is provided on a subscription basis. Subscriptions renew automatically unless canceled before the renewal date. Pricing may change with at least 30 days' notice. Fees are non-refundable except where required by applicable law. If payment fails, we may suspend your access until the balance is resolved.
9. Availability
We strive to maintain high availability of the Platform but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance when possible. The Platform depends on third-party services (including Meta APIs and AI providers) whose availability is outside our control. We are not liable for downtime caused by third-party service disruptions.
10. Limitation of Liability
The Platform and services are provided "as is" without warranties of any kind. Agentix shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Platform. Our total liability for any claim arising from these terms or the use of the Platform shall not exceed the total fees you paid to Agentix in the 12 months preceding the claim.
11. Termination
Either party may terminate the subscription at any time. Upon termination, you will have 30 days to export your data from the Platform. After this period, your data will be deleted in accordance with our privacy policy. Agentix may suspend or terminate your account immediately if you violate these terms or engage in activity that harms the Platform or other users.
12. Governing Law and Jurisdiction
These terms are governed by the laws of the State of Israel. Any dispute arising from these terms or the use of the Platform shall be adjudicated by the competent courts in the Tel Aviv district.
13. Changes to These Terms
We may update these terms from time to time. Material changes will be published on the website and communicated via email or in-app notification. Continued use of the Platform after an update constitutes acceptance of the updated terms.
